The present appeal has been filed inter alia praying for setting aside the judgment dated 11.02.2010 passed by the learned additional Sessions Judge, Patiala in FIR No. 79 dated 06.03.2008 under Sections 307 IPC read with Section 34 of Indian Penal Code, registered at Police Station Saddar, Patiala, whereby, the appellant-Ajaib Singh has been convicted and sentenced to undergo rigorous imprisonment for 05 years and to pay a fine of Rs. 5000/- and in default of payment of fine, to further undergo rigorous imprisonment for six months for having committed an offence punishable under Section 325 Cr.P.C.

Learned counsel for the appellant has submitted that the fine had already been deposited in the learned trial Court and has handed over PARUL 2024.03.12 10:13 I attest to the accuracy and authenticity of this document the receipt No. 02 dated 11.02.2010 in Court today.

However, learned State counsel has submitted that the appellant- Ajaib Singh has already been expired on 08.07.2020 and has placed on record the death certificate in Court today, which is taken on record.

In light of the above, the present appeal stands abated. 5.
