RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Gurdeep Singh, in case FIR No. 0062 dated 16.07.2018, registered under Section 22 of the NDPS Act at Police Station Bhadson, District Patiala, Punjab. According to the prosecution, the petitioner along with his co-accused-Zora Singh, was apprehended with conscious possession of 1000 ML intoxicant liquid of Codeine Phosphate besides 230 tablets of Carisoprodol.

Learned counsel inter alia contends that the petitioner has falsely been implicated in the instant case. The alleged recovery falls under 'small quantity'. Petitioner is in custody since 16.07.2018. CRM-M-5104-2019 -2purpose would be served by detaining her in jail. Co-accused, of the petitioner, namely; Zora Singh, has already been enlarged on bail by this Court, vide order dated 25.01.2019 passed in CRM-M-2635-2019. Thus, treating the case of the petitioner on the same parity, he may also be granted the concession of regular bail.

On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Gurdeep Singh, is ordered to be released on bail pending trial, treating his case on the same parity as that of his co-accused-Zora Singh, on his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
