The present appeal has been filed by the appellant against State of Punjab, challenging the order dated 09.09.2016 passed by learned Sessions Judge, Kurukshetra, vide which a sum of `50,000/- has been imposed as penalty upon the appellant being surety of the accused. Notice of motion was issued. Learned State counsel appeared and contested the appeal.

I have heard learned counsel for the appellant as well as learned State counsel and have gone through the record. At the time of arguments, learned counsel for the appellant only prayed for reduction of amount of penalty imposed upon the appellant. CRA No.S-1366-SB of 2017 -2Court and case has already been decided by the trial Court. In view of the above facts and circumstances, the penalty imposed upon the appellant is reduced and he is directed to pay penalty of `25,000/- instead of `50,000/-. As argued, in compliance of the order dated 06.04.2017 passed by this Court, `25,000/- has already been deposited by the appellant and order dated 21.07.2017, in this regard, passed by learned Sessions Judge, Kurukshetra, has been placed on record. Resultantly, present appeal stands partly allowed.
