The present Civil Writ Petition have been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing/setting aside the impugned order passed by the respondent-Department on 25.01.2024.

Learned counsel would contend that the petitioner has been wrongly not promoted despite the fact that 4 ACRs that had to be taken into consideration for the said purpose for the years 2018 to 2023, were all either very good or excellent, appended as Annexure P-3. A representation dated 27.01.2024 (Annexure P-5), filed by him has yet not evoked any response. He thus, at this stage on instructions, submits that the petitioner would be satisfied if a direction is issued to respondent No.3 to decide the said representation, in a time bound manner by granting him an opportunity of hearing. 3.

At the asking of the Court, Mr. D.K. Singal, Addl. AG Punjab accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.3 to look into the representation dated 27.01.2024 (Annexure P-5) and decide the same within a period of 3 months by passing a speaking order, in accordance with law, after associating the petitioner.
