-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.102 dated 1.4.2021 registered under Sections 379, 188, 120-B IPC and Sections 21(1), 4(1) and 4(1) A Mines and Minerals Act, at Police Station Ateli, District Mohindergarh.
Counsel for the petitioner inter alia contends that the petitioner was granted regular bail by the Court concerned but on account of his absence on 4.11.2022, the bail order was cancelled and now the petitioner is directed to be summoned through non-bailable warrants of arrest by the Trial Court. The counsel further submits that the absence of the petitioner on the relevant date before the trial Court is not intentional and rather the petitioner GAURAV SOROT 2023.02.07 16:29 I attest to the accuracy and authenticity of this order, judgment and documents.
( 2 ) CRM-M-6197-2023 being a driver by profession had gone out of State and as such failed to appear in the Trial Court on the date fixed. The counsel further more submits that it was first default on the part of the petitioner and he is ready to join proceedings in the Trial Court.
Notice of motion.
On the asking of the Court, Mr. Naveen Kumar Sheoran, DAG, accepts notice on behalf of State of Haryana and on instructions from ASI Asha submits that the petitioner jumped bail on 4.11.2022 and resultantly non-bailable warrants for his arrest were issued by the Trial Court. In view of the above, the present petition is disposed of with direction to the petitioner to appear before the Trial Court within next 20 days and on his doing so, the petitioner is directed to be released on regular bail on his furnishing bail and surety bonds to the satisfaction of Trial Court/Chief Judicial Magistrate concerned subject to cost of `5,000/- to be deposited by the petitioner with the District Legal Services Authority, Narnaul.
