The petitioner has filed the instant writ petition under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondents No.4 to 6 to conduct proper and fair investigation with regard to the irregularities in the recruitment process initiated vide advertisement No.01/2023 dated 28.01.2023 issued by respondent No.3 for the posts of Firemen and the Drivers/Operators.

Learned counsel for the petitioners submits that petitioners No.1, 2 and 4 were the candidates for the post of Drivers/Operators and petitioners No.5 to 8 were the candidates for the post of Firemen and petitioner No.3 applied for both the posts. The grievance raised in the present petition is that at the time of physical measurement test and physical efficiency test, which was conducted from 18.10.2023 to 23.10.2023 various irregularities have been committed by the concerned authorities. He submits that a detailed representation dated 15.11.2023 (Annexure P-6) was submitted by petitioner No.3 to the respondents. Ms. Niharika Sharma, A.A.G., Punjab, who is present in Court, accepts notice on behalf of the respondents No.1 to 6. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.2-Competent Authority is directed to consider and decide the claim made by the petitioner in the representation 15.11.2023 (Annexure P-6) in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order.

The petition stands disposed of.

However, liberty is granted to petitioners No.1, 2 and 4 to 8 to file a supplementary representation within a period of one week, which shall be decided by respondent No.2 along with representation 15.11.2023 (Annexure P-6) made by petitioner No.3.
