CWP-4138-1987 was disposed of vide order dated 23.12.2010 with the observations as follows:- "Consequently, all the writ petitions are allowed. The notices and the orders impugned in the writ petitions are set aside. Further, to give full and complete effect to the present order, restoration of possession is ordered in such cases where any of the petitioners have been dispossessed." Learned counsel for the petitioner submits that petitioner got demarcation of his land on 26.10.2016 and found that certain persons have illegally encroached upon his land.
As per order dated 23.12.2010, possession of the land, which was taken by the authorities in pursuant to order which was set aside, was to be restored.
The petitioner has put forth altogether a different case about encroachment on his land by certain persons in the village as found in the JITENDER KUMAR 2020.02.07 13:59 I attest to the accuracy and integrity of this document Chandigarh
COCP No. 513 of 2020 -2demarcation report dated 26.10.2016. As per reply of the respondent, another demarcation was conducted and the petitioner was found in possession of excessive land than his ownership. At this stage, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to petitioner to avail other legal remedies available to him in accordance with law.
