SUDIP AHLUWALIA, J. (ORAL) The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking interim regular bail for 30 days to the Petitioner in case FIR No.1206, dated 28.12.2017, registered under Sections 365 of the Indian Penal Code, 1860 (Sections 364, 397, 302, 201, 408, 120B of the IPC, added later on) at Police Station Chandni Bagh, Panipat, District Panipat.

Seen the Status Report by way of Affidavit of the Deputy Superintendent of Police, Madlauda, District Panipat filed on behalf of the Respondent/State, in Para No.6 of which, it has been mentioned that on inquiry it was verified that the Petitioner's minor daughter, aged 9 years, is suffering from Cancer and is presently admitted in PGIMS Rohtak, and apart from the widowed mother and wife of the Petitioner (who is claimed DEEPAK KUMAR 2021.03.01 03:55 I attest to the accuracy and integrity of this document
CRM-M No.7341 of 2021 -2to be illiterate) and the minor son Raman, aged 5 years, there is no one in his family to do the needful for getting the requisite medical treatment provided.

For this reason, purely on humanitarian considerations, the Petitioner is permitted to be released on an interim bail for a specific and limited period of 30 days only from the date he is actually released, subject to imposition of appropriate terms and conditions including bail surety which are left to the discretion of the Ld. Trial Court/Duty Magistrate concerned. After completion of this 30 days' interim bail, the Petitioner shall himself surrender in the concerned Jail. 4.
