1 9 "Vide order dated 24.08.2023, Hon'ble Punjab & Haryana High Court in CRM-M-6255-2024, "has directed lower Court to record statement of compromise if any between parties after satisfying that same is voluntarily and without any pressure. Apart from this, Hon'ble Court has directed trial Court to report regarding following facts:

i) Whether there is any other accused other than the petitioner, arrayed in this petition;

ii) Whether there is any other complainant or affected/aggrieved party other than the respondents, arrayed in the petition. iii) Whether any accused has been declared proclaimed offender. Complainant namely Navjot Kaur @ Sunita wife of Baldev Singh and Amarjeet Singh son of Chhinda Singh have got recorded their statement separately to the effect that the matter has been compromised with accused in case FIR No.480 of 2022 with the assistance of Panchayat. They also deposed that they have no objection if aforesaid FIR is quashed against accused. Accused Baldev Singh son of Amrik Singh resident of Dhani Sangatpura, Tehsil Rania, Sirsa has made separate statement to the effect that the matter has been compromised with complainant with the assistance of panchayat. They requested to quash the aforesaid FIR.

Investigation Officer SI Ran Singh, Belt no.776/SRS Police Chowki Khairpur, Sirsa was also called who suffered statement to the effect that only Baldev Singh is accused in present case. There is no other case against aforesaid accused. No accused has been declared as PO in this case.

Both the parties were duly identified by their respective lawyers. Complainant and accused also submitted copy of their identity cards.

Besides recording the statements of the parties, the Court has also duly enquired about the compromise between two sides independently from the complainant and accused as well as their counsels. Both the counsels representing the parties have also stated that the matter has been compromised between the parties with their free consent and there is no ill will between them. So, after perusal of statements of the parties and after enquiring from the parties independently as well as their counsels, the Court is of the opinion that the compromise arrived between the parties is genuine and voluntarily made, without any undue influence, coercion threat or pressure.

No other person except above-mentioned Baldev Singh is nominated as accused in present case. No other person except complainant is aggrieved in present case. No accused has been declared proclaimed offender. No case against present accused is lying pending in any court except present one. Present case is at the stage of prosecution evidence. The requisite report is being submitted please as desired. Encl: Original statements of complainant and both accused."
