IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH Date of decision: 03.02.2025 Pawandeep Singh ....Petitioner

Versus

State of Punjab and others ....Respondents CORAM: HON'BLE MR. JUSTICE HARPREET SINGH BRAR

Present:

Ms. Amandip Kaur, Advocate for the petitioner.

HARPREET SINGH BRAR J. (Oral) 1.

The present writ petition has been filed under Section 528 of BNSS, for issuance of directions to respondents No.1 to 3 to take legal action against respondents No.4 and 5 and register an FIR under the relevant Sections of BNS, on the basis of the representations dated 16.01.2025 and 21.01.2025 (Annexures P-2 and P-3), respectively submitted by the petitioner with respondents No.2 and 3. Further prayer has been made to protect the life and liberty of the petitioner and his family members, at the hands of respondents No.4 and 5 2.

Learned counsel for the petitioner, inter alia, contends that the petitioner's sister, Gagandeep Kaur, tragically died under suspicious circumstances on 03.01.2025, after being taken from the petitioner's residence by respondents No.4 and 5. The petitioner was initially informed that Gagandeep had fallen from the second floor, however, it is the petitioner's belief that she was murdered by the respondents, who

conspired to take her life and stage her death as a suicide in order to destroy evidence. He further submits that the deceased's personal belongings, including a gold ring, mobile phone, and money, were stolen by the respondents.

3.

Learned counsel for the petitioner further submits that the local police, under the influence of respondent No.4, have failed to conduct a thorough investigation and are attempting to protect the perpetrators. Despite the petitioner's repeated efforts to seek justice, including submitting representations dated 16.01.2025 and dated 21.01.2025 (Annexures P-2 and P-3, respectively) to higher authorities, no action has been taken till date.

4.

Learned counsel for the petitioner further submits that the petitioner would be satisfied, in case a direction is issued to respondent No.2 to consider and decide the representation dated 16.01.2025 (Annexure P-2) submitted by him in a time bound manner. 5.

Notice of motion to the official respondents only. 6.

On asking of the Court, Mr. Subhash Godara, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1 to 3 - State. Learned counsel for the petitioner is directed to supply copy of complete paperbook to counsel opposite during the course of the day. 7.

Keeping in view the prayer made by the petitioner and without commenting anything on the merits of the case, present petition is disposed of with a direction to respondent No.2 to consider and decide the representation dated 16.01.2025 (Annexure P-2) submitted

by the petitioner within a period of four weeks from the date of receipt of certified copy of this order, in accordance with law. (HARPREET SINGH BRAR) JUDGE 03.02.2025 yakub Whether speaking/reasoned:
