Mahesh Sharma @ Mahesh Dutt Sharma v. State Of Punjab
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CRM-M-5253-2020 Date of decision: 06.02.2020 Mahesh Sharma @ Mahesh Dutt Sharma ..... Petitioner
Versus
State of Punjab ..... Respondent
CORAM:
HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. PS Kanwar, Advocate for the petitioner. RAMENDRA JAIN, J. (ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to petitioner-Mahesh Sharma @ Mahesh Dutt Sharma, in case FIR No. 207 dated 05.12.2019 registered under Section 379-B IPC at Police Station City Hoshiarpur, District Hoshiarpur.
According to prosecution, in the evening of 02.12.2019, petitioner snatched the purse of complainant-Harpreet Kaur, containing mobile phone, `1500/- in cash and pass-book of her bank account. Learned counsel for the petitioner inter alia contends that FIR was registered after delay of three days against some un-known person. Petitioner has falsely been implicated by the police, without any evidence against him. There are clean antecedents of the petitioner. Considering the overall circumstances and the fact that snatching incidents have increased manifolds in the recent past and that recovery of mobile phone and purse of complainant has to be effected from the petitioner, this Court finds that petitioner is required for custodial interrogation. Thus, he does not deserve the concession of anticipatory bail. Dismissed.
