Challenge in the present petition is to the order dated 14.11.2023 passed by the authority whereby the application/representation of the petitioners against a show cause notice dated 29.03.2023 issued by the respondent-Department for discontinuing the 'Old Age Samman Allowance Scheme' and for effecting recovery thereof has been dismissed. Learned counsel for the petitioners is confronted with the fact that the school leaving certificate referred in the complaint submitted against petitioner No.1 mentioned the date of birth as December-1958 whereas in the certificate submitted by petitioner No.1 for seeking pension under the Samman allowances mentioned the date of birth as January-1950, which such issue would be disputed question of facts requiring leading of evidence, he seeks permission to withdraw the present petition with liberty to the petitioners to take recourse to the alternative efficacious remedies available to him in accordance with law.

Disposed of as withdrawn with the liberty as aforesaid.
