*** Ritu Bahri, J. (Oral) C.M. No. 8372-CII-2022 in/and FAO No. M-36-2019 The present application is for withdrawal of the main appeal, as the matter stands compromised between the parties, by way of mutual agreement.

Learned counsel for the applicant-appellant states that as per mutual agreement, the respondent has agreed that he will give Rs.11 lakh as past, present and future maintenance to the appellant. Out of the above amount, Rs.8,50,000/- has already been paid by way of bank draft/cheque and Rs.2,50,000/- is now payable. This amount will be paid after the appellant will withdraw the present appeal.

In view of the above factual position, the application is allowed and the appeal is taken up for hearing today itself for disposal and the same is ordered to be dismissed as withdrawn with a liberty to the appellant that in case the conditions of the mutual agreement are not being complied with by the respondent, she can revive this appeal.
