**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 57 dated 5.5.2018 under Sections 302/341/324/148/149 IPC registered at Police Station Majitha, Tehsil and District Amritsar.

Learned counsel for the petitioner submits that the petitioner has not been named in the FIR and the eye witness Jugraj Singh has appeared before the trial Court as PW-1 and resiled from his earlier statement. Learned counsel further submits that co-accused Lovepreet Singh @ Love, who has been named in the FIR, has been granted the concession of regular bail by this Court vide order dated 27.1.2020. He further submits that the petitioner has been in custody since 1.6.2018. Learned State counsel, on instructions from ASI Shashpal Singh, submits that out of 26 prosecution witnesses, 02 witnesses have been examined.

CRM-M No. 5477 of 2020 -2Lovepreet Singh @ Love has already been granted regular bail by this Court. Out of 26 prosecution witnesses, only 02 witnesses have been examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
