This petition has been filed for issuance of a writ in the nature of certiorari for quashing the orders dated 25.01.2024 and 31.01.2024 (Annexure P10 and P11) vide which the persons have been promoted to the post of District Education Officer and the petitioner is being demoted to the post of Principal DIET, Jalandhar.

Learned State counsel submits that CWP-2181-2024, involving the similar issue as in the present case, has already been dismissed by this Court vide judgment dated 01.02.2024, who is unable to controvert the said fact. The operative part of which reads thus:

"2. This Court finds that the petitioner is holding a post of substantive Principal and the post of the District Education Officer is a promotional post, and after the DPC made recommendations, the post is being filled from a regularly promoted District Education Officer. The petitioner has not been promoted as District Education Officer, he, therefore, cannot claim continuance on the higher post and has to hand over the charge to the concerned District Education Officer who has been recently promoted on the said post."
