(ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.61 dated 16.05.2017 under Sections 379-B, 411, 420, 465, 467, 468, 471, 472, 34 IPC registered at Police Station Sujanpur, District Pathankot. Counsel for the petitioner inter alia would contend that the petitioner herein has been falsely implicated in the said matter as the petitioner herein was not named in the FIR. The FIR was initially registered against three unknown persons. The investigation is complete and the challan stands presented. The co-accused has already been allowed interim bail by this High Court vide order dated 29.01.2018 passed in CRM-M No.24622 of 2017 titled as Harsh Bhardwaj Vs. State of Punjab. No recovery is to be effected from the petitioner herein. The trial is likely to take some time to conclude and therefore, prays for concession of bail to the petitioner.

CRM-M No.7509 of 2021 (O&M) -2Learned counsel appearing for the respondent-State opposes the bail application of the petitioner by contending that the petitioner herein snatched scooty from the complainant and also caused injuries to him. I have heard learned counsel for the parties. Keeping in view the fact that the challan stands presented and no recovery is to be effected from the petitioner herein and the trial is likely to take some time to conclude, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
