The petitioner has been booked for offence under Section 18 of the NDPS Act, as well as Section 27-A of the NDPS Act. Notice of motion.
At this stage, Mr. Tanuj Sharma, AAG, Haryana, has accepted notice on behalf of the State.
There is bar of Section 37 of the NDPS Act, for grant of bail in case a person who has been booked for offence under Section 27-A of the NDPS Act. Furthermore, as stated by the State counsel, the accused has been convicted in a case under the NDPS Act. Realising that the Court is not inclined to grant pre-arrest to the petitioner, counsel for the petitioner states that he be permitted to withdraw the present petition. Allowed.
