In the present petition, the prayer of the petitioner is that the petitioner is entitled for the grant of additional increment on the completion of 08 years of service by including the ad-hoc service rendered by the petitioner.

Learned counsel for the petitioners fairly submits that after the filing of the present petition, the said issue has already been dealt by the then Co-ordinate Bench of this Court by passing the order in CWP No.10820 of 2004 tilted as 'Subhash Chand and others v. State of Haryana and others', decided on 31.10.2018, wherein, it has been held that the benefit of increment or additional increment cannot be given by counting ad hoc service rendered by an employee prior to his regularization.

Learned counsel for the petitioner further submits that keeping in view the said principle of law as settled by the then CoRIYA 2023.11.22 17:24 I attest to the accuracy and integrity of this document

CWP-3409-1994 (O&M) 2023:PHHC: 148661 ordinate Bench of this Court in Subhash Chand's case (supra), the prayer of the petitioner is not maintainable, hence, the present petition may kindly be disposed of having not pressed any further. 4.

Keeping in view the fact that learned counsel for the petitioners has conceded that the decision of Subhash Chand's case (supra), which has come into being after the filing of the present writ petition, covers the case of the petitioner against him, accordingly, the present petition stands disposed of having not pressed any further in terms of Subhash Chand's case (supra).

Civil miscellaneous application pending, if any, is also disposed of.
