The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.420 dated 16.12.2010 registered for the offences under Sections 419, 420 and 120-B IPC at Police Station Tosham, District Bhiwani.
Notice of motion to Advocate General, Haryana. Mr. Navdeep Singh, learned Assistant Advocate General, Haryana has appeared on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the FIR is of the year 2010. The HARPAL SINGH PARMAR 2019.03.15 16:39 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-5339 of 2019 [2] present petitioner in the case has been declared proclaimed offender and now he has been arrested on 14.8.2018. From the record, I find that the petitioner, if granted the benefit of bail, there is every chance that he may abscond again. Therefore, no ground is made out for grant of bail to the present petitioner.
Keeping in view the facts and circumstances of the present case, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail.
However, as the case is relating to the FIR of the year 2010, the trial Court is directed to expedite the trial by giving short adjournments and if required even day to day adjournments.
With these observations, the criminal miscellaneous petition is dismissed.
