(ORAL) Through this second petition on behalf of petitioners No.1 and 2 and third petition on behalf of petitioner No.3, under Section 439 Cr.P.C. prayer has been made for grant of regular bail to them in a case arising from FIR No.593 dated 20.07.2018, registered under Sections 379-A, 120-B, 411 and 34 IPC, Police Station City District Sonipat. According to the prosecution, on 20.07.2018, petitioners in conspiracy with each other snatched a polythene bag containing `2,10,000/- from the wife of the complainant near Hindu College, Sonepat and, thereafter, fled away.
Learned counsel contends that both the material witnesses namely complainant-Jagpal (PW-1) and his wife Murti Devi (PW-2) SONIKA 2019.02.13 15:25 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-5313 of 2019 --2-- have turned hostile. The petitioners have falsely been implicated in the instant case. The petitioners are in custody since 20.07.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioners in jail any more during trial.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioners are ordered to be released on interim bail till conclusion of trial, on their furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
