-.- JAISHREE THAKUR J. (ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.133 dated 11.09.2020 under Sections 420, 465, 471, 120-B IPC registered at Police Station Dayalpura, District Bathinda.

Counsel for the petitioner inter alia would contend that the matter has been compromised between the parties and based on the compromise, a petition bearing CRM-M No.5301 of 2021 has been preferred before this High Court for quashing of the FIR in question, in which notice of motion has been issued for 04.03.2021. Appearance has been caused for the complainant by Mr. B.B.S. Randhawa, Advocate, who admits to the factum of the compromise and submits that the complainant has no objection in case the petitioner herein is released on bail.

CRM-M No.7564 of 2021 (O&M) -2I have heard learned counsel for the parties. Keeping in view the fact that the matter has been compromised between the parties and based on the said compromise, a petition for quashing of the FIR has already been filed before this High Court, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
