**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through video conferencing.

Petitioner has preferred this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case bearing FIR No.129 dated 26.09.2016 registered under Sections 148, 149, 307, 323, 341, 326 IPC at Police Station Raipur Rani, District Panchkula.

Petitioner has labelled this petition as first petition under Section 438 Cr.P.C.

Office has pointed out that earlier petitioner filed CRM-M No.4683 of 2017 which was allowed thereby making interim bail as absolute vide order dated 17.04.2017. Thereafter, JYOTI SHARMA 2022.02.24 13:57 I attest to the accuracy of this order

CRM-M No. 7134 of 2022 -2after filing of challan, petitioner was granted regular bail by the trial Court vide order dated 26.05.2021.

Petitioner has pleaded in the petition that the parties on account of some compromise have also filed CRM-M No.9479 of 2020 which is pending in the High Court. On 20.07.2021, the petitioner could not appear before the trial Court due to wrong recording of date as 23.07.2021 and owing to aforesaid fact, the petitioner absented from the trial Court on 20.07.2021 resulting in issuance of nonbailable warrants. Now, the petitioner is ready to surrender before the trial Court.

No ground is made out to grant anticipatory bail to the petitioner.

Dismissed.

However, the petitioner would be at liberty to surrender before the trial Court and may apply for regular bail. In the event of doing so, the trial Court shall decide the same at the earliest in accordance with law.
