Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.101 dated 20.5.2020 under Sections 302, 34 IPC, registered at Police Station Sadar Nabha, District Patiala. Counsel for the petitioner submits that as per the allegations in the FIR, registered at the instance of Manjit Singh, it is stated that DDR No.16 dated 15.3.2017 was registered on his statement that the complainant is working in police department and is having two daughters and one son. On 14.3.2017, his only son-Sagandeep Singh had gone to brought his friend Jagjit Singh @ Mithu-petitoner and while coming back, he fell down from the scooter and started vomiting and he has doubt that some poisonous substance was given to his son Sagandeep Singh and due to which he died.

Later on, the complainant made another statement stating that petitioner-Jagjit Singh @ Mithu was known to his son and used to visit him. However, he was feeling jealous with the life of Sagandeep Singh and started giving him poisonous substance. On the date of incident, after repairing the CCTV camera, the petitioner took tea with his deceased son and took him to a liquor vend and in the meanwhile, Dharminder Singh @ Monu, brother of Jagjit Singh @ Mithu came and asked his son to drop them to their village and took his son SATISH KUMAR 2022.04.

It is stated that the petitioner has killed his son along with the other accused. Counsel for the petitioner submits that the brother of the petitioner, namely-Dharminder Singh @ Monu has already been granted the concession of anticipatory bail vide order dated 2.11.2021 in CRM-M-7502021. A perusal of the order would show that Dharminder Singh @ Monu was granted the concession of anticipatory bail as it was specifically observed that suspicion was on Jagjit Singh @ Mithu and not on his brother Dharaminder Singh @ Monu.

Learned State counsel, on the basis of the affidavit of DSP, Sub Division Nabha, District Patiala, after verifying the contents of the FIR and the investigation conducted as well as on the basis of the FSL report submit that the cause of death was Organophosphorus. It is further stated that during investigation the petitioner has called deceased Sagandeep Singh and later on, he was taken by the petitioner, his brother and two other persons to a liquor vend where they consumed the liquor and in that process, they administered him some poisonous substance.

After hearing learned counsel for the parties and considering the fact that the petitioner is the main accused and his custodial interrogation is required, I find no ground to grant the concession of anticipatory bail to the petitioner.
