RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner - Gurmej Singh @ Kala - in a case arising from FIR No.0430 dated 23.12.2019 registered under Section 21 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Nissing, District Karnal.

According to the prosecution, on 23.12.2019, petitioner was found in conscious possession of 3kgs 10 grams of Camphorated Opium Tincture BP, contained in eight plastic boxes, without any permit or licence. Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 23.12.2019.
