(Oral) Learned counsel for the petitioner has filed the present petition seeking direction to the official respondents to take over the physical possession of the mortgaged properties, as described in Section 13 (2) notice dated 11.06.2018/ (P-1) and hand over the same to the petitionerBank. Learned counsel for the petitioner submits that in this regard, order dated 07.01.2019 (P-3) has already been passed by respondent No. 2 under Section 14 of SARFAESI Act, 2002 but the same has not been complied with till date.

CWP-3885-2021 Tehsildar Ludhiana (East) has informed the Court that the Bank official had not approached the Tehsildar and now a notice has been issued to the parties for 01.03.2021 by the Tehsildar to appear before him, for compliance of order dated 07.01.2019 (P-3).

In view of the above factual position, the present petition stands disposed of by giving a direction to respondent No. 3 and 4 to comply with order dated 07.01.2019 (P-3), in accordance with law, within a period of three weeks' from the date of receipt of certified copy of this order.
