detail, the then Superintendent of Police, (Headquarters), Amritsar (Rural) submitted his detailed report No. 184-5AP dated 20.10.2022 recommending to declare the petitioner innocent, which was approved by the Senior Superintendent of Police, Amritsar (Rural).

9. That the co-accusedKabal Singh was arrested by the investigating officer on 27.04.2023 during the course of the investigation.

10. That an Investigation Report/Challan under section 173 Cr.P.C. has been submitted in the court of learned Judicial Magistrate First Class, Amritsar on 24.07.2023 against the coaccused Kabal Singh, which was committed to the court of learned Sessions Judge, Amritsar vide order dated 23.11.2023. A total of 17 prosecution witnesses have cited in the aforesaid investigation report/challan. The learned trial court has framed a Charge under section 302 and 120-B IPC against the co- accused Kabal Singh, to which he pleaded not guilty and claimed trial. So far no prosecution witness has been examined by the learned trial court. Now the next date of hearing is fixed on 21.10.2024 for the prosecution evidence." 5.

In view of the above, the present petition is dismissed as having been rendered infructuous.
