RAMENDRA JAIN, J. (ORAL) Through this second petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Vikram @ Vicky, in case FIR No. 92 dated 16.03.2018 registered under Sections 307, 302, 148, 149, 506 and 120-B IPC and Section 25 of the Arms Act at Police Station Bhupani, Faridabad (Haryana).
According to the prosecution, the petitioner is facing trial in aforesaid FIR, on the allegation of murder of one Manoj. Learned counsel inter alia contends that petitioner was named in the aforesaid FIR, only on the basis of suspicion. The material witnesses have turned hostile. Petitioner is in custody since 14.04.2018. Conclusion of trial may take sufficient long time. No useful purpose would be served by detaining him in jail. CRM-M-5299-2019 -2petitioner, namely; Bharat @ Sachin, has already been enlarged on bail by this Court, vide order dated 25.01.2019 (Annexure P-10) passed in CRM-M-61953-2018. Thus, treating the case of the petitioner on the same parity, he may also be granted the concession of regular bail. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Vikram @ Vicky, is ordered to be released on bail pending trial, treating his case on the same parity as that of his co-accused-Bharat @ Sachin, on his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
