complainant gave his statement that he had called the victim 'RK' his sister-in-law to the house to look after his wife i.e. the sister of the victim who had given birth to a child. At the time of occurrence, the victim was about 17 years 10 months old. On 13.06.2020 at about 11:00 AM, the victim left the house along with Vijay Bhardwaj who enticed her to accompany him. He tried to search the victim
but could not locate her whereabouts. Finally, the matter was reported to the police. The victim was recovered. She was medically examined and her statement was recorded under Section 164 Cr.P.C. on 05.09.2020. After competition of investigation, challan was presented in the Court. 3.
Learned counsel for petitioner argued that petitioner was arrested on 26.03.2021. His custody is about 04 years. Till date 04 prosecution witnesses have been examined. In fact the victim had left the house on her own. All allegations levelled against him are false. He is ready to abide by the terms of bail order. 4.
Bail petition is opposed by learned counsel representing State. Detailed status report has been filed. It is confirmed that challan in this case was presented on 23.04.2021. Charge-sheet was framed on 19.08.2021 and till date out of 28 prosecution witnesses, only 04 witnesses have been examined. Regular bail petition is opposed on the ground that there are specific allegations against the petitioner and the victim has also supported the prosecution case. 5.
I have considered the arguments and have gone through the record carefully. So far as the facts of the case and allegations levelled against the petitioner are concerned, the same is matter of trial. It cannot be ignored that challan in this case was presented on 23.04.2021 and after framing of charge-sheet till date only 04 prosecution witnesses have been examined. Material witness i.e. the victim is already examined. Custody of petitioner is more than 04 years. Trial in this case may take long time. Therefore, without expressing my mind on merits of the case, $,-1-
