RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Paramjit Kaur in a case arising from FIR No.01 dated 01.01.2018 registered under Sections 302, 201, 34, 120-B IPC at Police Station GRPS, Pathankot, District Pathankot, Punjab.

Petitioner along with her two sons is facing trial in the aforesaid FIR on the allegations that in the night of 31.12.2017, she murdered her husband having a grudge against him that he was having illicit relations with a lady, namely, Devinder Kaur @ Pinder wife of Kuldeep Singh.

On the last date of hearing, a Co-ordinate Bench of this Court, directed the prosecution to examine Devinder Kaur @ Pinder, who, according to learned State counsel has been examined. RAVINDER SINGH 2020.02.03 16:52 I attest to the accuracy and integrity of this document

-2CRM-M-5263 of 2019 Learned counsel for the petitioner inter alia contends that entire case is based on circumstantial evidence inasmuch as there is no eyewitness to the occurrence. Alleged knife used in the crime was not recovered from the petitioner, rather was collected by the police much before the arrest of the petitioner. Petitioner is a lady. She has falsely been implicated in this case on the basis of suspicion. Petitioner is in custody since 08.02.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner - Paramjit Kaur is ordered to be released on bail during pendency of trial, if not required in any other case, on her furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
