ARUN PALLI, J. ( Oral ) Learned counsel for the petitioner submits that the ground on which the petitioner was declared technically non-responsive is apparently erroneous: "Documents not as per MTF." However, having argued the matter at some length, he submits that he be permitted to withdraw the petition, to enable the petitioner to move the competent authority qua its concerns/grievances, by filing a comprehensive representation, in the first instance.
Served with the advance copy of the petition, Mr. Sunish Bindlish, learned Senior Standing Counsel for the respondent-FCI, is present in Court. He submits that in the event any such representation is moved by the petitioner, the same shall be taken cognizance of by the competent authority. And necessary orders, in accordance with law, shall be passed thereon, as expeditiously as possible. As prayed for, dismissed as withdrawn.
