This petition has been filed under the provisions of Section 439 of the Cr.P.C. seeking 'regular bail' for the petitioner in case FIR No.59 dated 04.05.2020, registered at Police Station STF, SAS Nagar Mohali, for the alleged commission of offences punishable under Sections 18, 21, 25 and 29 of the NDPS Act, 1985.

Learned counsel for the petitioner submits that in fact at this stage he is not pressing on the petitioner being admitted to "regular bail", but only seeks interim bail, with a child having been born to the petitioner; and his wife (the wife also being a co-accused), having been admitted to interim bail by this court on the ground that the child had developed jaundice in the jail.

It is to be noticed that thereafter in fact the interim bail granted to the petitioners' wife has been extended by this court vide an order dated February 24, 2020 passed in CRM-M-36475 of 2020, only on the contention VIKAS CHANDER 2021.03.01 10:06 I attest to the accuracy and integrity of this document

223) CRM-M-8015 of 2021 -2of the learned counsel for the petitioner appearing in that case, that since the baby is still not even 4 months old, the interim bail may be extended, though she/he has recovered from jaundice.

Hence, when this court was not inclined to grant either interim bail or regular bail to the present petitioner, learned counsel seeks to withdraw this petition, at this stage.

Dismissed as withdrawn.
