(ORAL) The Petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus directing the respondent to release stage carriage permit in favour of the petitioner on Barretta to Mankhera via Budhlada, Mansa, Jhunir, Sardulgarh route .
Learned counsel for the petitioner submits that despite fulfilling all the legal requirements, the respondent has not initiated any action for the release of the permit in question and it was obligatory on the part of the respondent to have issued One Time Password to the petitioner for depositing the fee prescribed by the Government for lifting the permit. CWP No.2488 of 2023 -2unless and until One Time Password is given by the Department for the purposes of depositing the fee in question. The petitioner has also ventilated his grievance by means of representation dated 12.12.2022 and the same has not been adverted to by the respondent in the context of doing the needful for releasing his permit.
At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case his representation dated 12.12.2022 is ordered to be decided by the respondent in accordance with law in a time bound manner. Notice of motion.
On the asking of the Court, Mr. Sanjeev Soni, Addl. A.G., Punjab accepts notice on behalf of the respondent and submits that the representation of the petitioner dated 12.12.2022 shall be considered and decided in accordance with law within a period of one month from the date of receipt of certified copy of this order.
