This is a petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing the order dated 17.11.2021 (Annexure P-5) passed by learned Judge Special Court, Amritsar in case bearing NDPS/133/2021 titled as "State of Punjab Vs. Akashdeep Singh @ Akash etc.", whereby the bail granted to the petitioner on 17.07.2019 has been cancelled and the petitioner has been summoned through non-bailable warrants.

Learned counsel for the petitioner would contend that on 17.11.2021 the petitioner could not appear before the Court since he was suffering from fever and that on all other dates he had been appearing. He would further contend that the petitioner is ready to surrender before the Trial Court and join the proceedings.

CRM-M-7366-2022 (O&M) -2On the asking of the Court, Mr. H.S. Multani, AAG Punjab accepts notice on behalf of the State and he, on instructions, points out that the first date when the petitioner did not appear before the Court was 01.09.2021 for which no explanation is forthcoming. It is only on the second date that non-bailable warrants were issued against the petitioner. Heard.

Keeping in view the fact that the petitioner was on bail and had absented himself on two dates, I deem it appropriate to dispose off the present petition with a direction that the petitioner shall surrender before the Trial Court/Additional Sessions Judge (Duty) concerned within a period of seven days from today and in case he does so and files an application for grant of bail, the same shall be heard and decided expeditiously. Disposed off accordingly.
