(Oral) The present petition has been filed by the petitioner seeking quashing of order dated 16.12.2022 (Annexure P-3), whereby the bail order of the petitioner was cancelled and he was directed to be summoned through non-bailable warrants of arrest by the Court of Additional Sessions Judge, Panchkula in criminal case having FIR No.133 dated 22.4.2019 (Annexure P-1).

The counsel for the petitioner submits that the petitioner was granted regular bail vide order dated 29.5.2019 (Annexure P-2) and thereafter the impugned order was passed by the learned trial Court on account of absence of the petitioner. The counsel for the petitioner further submits that the absence of the petitioner was not intentional and this was GAURAV SOROT 2023.02.14 11:18 I attest to the accuracy and authenticity of this order, judgment and documents.

( 2 ) CRM-M-7065-2023 the first default on the part of the petitioner and that the petitioner is ready to join the proceedings in the learned trial Court. Notice of motion.

On the asking of the Court, Mr. Vishal Kashyap, DAG, accepts notice on behalf of State of Haryana and submits that in the present case the petitioner jumped bail on 16.12.2022 and resultantly his non-bailable warrants of arrest were issued by the learned trial Court. In view of the above, instant petition is disposed of and the petitioner is hereby directed to appear in the learned trial Court within next 20 days and on his doing so, the petitioner is directed to be released on regular bail by the said Court on his furnish bail and surety bonds to its own satisfaction, subject to cost of `5,000/- to be deposited by the petitioner with the District Legal Services Authority, Panchkula.
