NIDHI GUPTA, J. (ORAL) Prayer in this Ist petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 316 dated 22.09.2023 registered under Section 365 IPC (Sections 363, 366, 376(2)(n) IPC and Sections 6 and 17 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Chappar, District Yamuna Nagar, Haryana.

Learned counsel for the State has filed custody certificate dated 10.02.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 03 months and 22 days.

After arguing for some time, when this Court is not inclined to grant bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage. Permitted to do so.

Dismissed as withdrawn, at this stage.
