Criminal Misc. Application bearing No.CRM-13400-2025, under Section 528 of BNSS, 2023, has been filed seeking withdrawal of the main case i.e. CRM-M-6506-2025, which is listed for 11.08.2025 2.

In the main case, on 07.02.2025, following order was passed:- "

Present petition has been filed under Section 483 of BNSS, seeking regular bail in case FIR No.240 dated 19.08.2024, under Sections 309(4), 309(6) and 238 of BNS, registered at Police Station Kalayat Kaithal, District Kaithal.

Learned State counsel submits that after submission of the final report under Section 173 Cr.P.C., charges have been framed and now the case is fixed for 10.02.2025 for recording of the prosecution evidence. Counsel submits that till date only one prosecution witness has been examined.

Learned State counsel is not in a position to explain whether complaint has been examined or not?

List on 26.03.2024.

Meanwhile, prosecution would ensure the recording of the statement of complainant as well as all material witnesses. Let copy of this order be forwarded to learned trial Court for information and necessary compliance."

In view of the prayer and the averments made in the application, which is supported by an affidavit of the applicant-petitioner, date of hearing in the main case is pre-poned from 11.08.2025 to today itself i.e. 04.04.4025, and same is taken on board for its disposal.
