(ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.123 dated 02.09.2020 under Sections 307, 353, 379-B, 332, 333, 323, 324, 186, 120B, 506, 148, 149, 188, 269, 270 & 271 IPC and Section 51 & 53 of the Disaster Management Act, 2005 registered at Police Station Hariana, District Hoshiarpur.

Learned counsel for the petitioner inter alia would contend that the petitioner herein is in custody since 07.09.2020. The investigation is complete and the challan stands presented. The injuries inflicted upon the complainant party are simple in nature and therefore, no offence under Section 307 IPC is made out. No recovery is to be effected from the petitioner and therefore, his custodial interrogation would no longer be required.

CRM-M No.7601 of 2021 (O&M) -2to the petitioner by contending that the petitioner herein along with coaccused caused injuries to the policy personnel, who were performing their duties during the times of night curfew imposed in the area owing to COVID-19 pandemic.

I have heard learned counsel for the parties. Keeping in view the fact that the investigation is complete and the challan stands presented and no recovery is to be effected from the petitioner, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
