Learned counsel for the petitioner admits that this bail application has been filed with factually incorrect averments. On 03.12.2019, another bail application was filed by the same counsel on behalf of the petitioner, which was dismissed with the following order:- "Prayer is for grant of bail pending trial in a criminal case arising from FIR No.0235 dated 12.05.2019 registered under Sections 147, 148, 149, 307, 323, 341, 427, 506, 120-B of the Indian Penal Code and Section 25 of the Arms Act at Police Station City Fatehabad, Fatehabad.

In the captioned, it has been averred as under:- "First Petition under Section 439 of the Code of Criminal Procedure, for the grant of regular bail in case bearing FIR No.0235 dated 12.05.2019 DEEPAK KUMAR BHARDWAJ 2020.03.05 11:30 I attest to the accuracy and integrity of this document

Criminal Misc. No. M-6662 of 2020 registered under Section 147, 148, 149, 307, 323, 341, 427, 506, 120-B IPC and Section 25 of Arms Act, 1959 at Police Station City Fatehabad, Fatehabad."

On being confronted, learned counsel for the petitioner admitted that this is not the first bail application of the petitioner.

Dismissed, on the ground of concealment of fact". Thus, the conduct of the learned counsel for the petitioner is not appreciated. Learned counsel for the petitioner prays for permission to withdraw the present petition.

Ordered accordingly.
