-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in FIR No.54 dated 07.03.2019 under Sections 302, 201, 148, 149 IPC registered at Police Station Mandi Gobindgarh, District Fatehgarh Sahib.

Counsel for the petitioner herein would contend that the petitioner herein is in custody since 07.03.2019. Charges in the instant matter have been framed and the material witnesses stand examined, who have not supported the case of prosecution. It is further argued that the trial is likely to take some time to conclude and therefore, the petitioner is entitled for concession of regular bail.

Whereas learned counsel appearing on behalf of the respondent-State opposes grant of bail to the petitioner by contending that there is enough evidence available with the prosecution to establish that the petitioner herein is involved in the murder of the husband of Jasbir Kaur as PANKAJ KUMAR 2021.04.09 17:41 I attest to the accuracy and integrity of this document

I have heard learned counsel for the parties and keeping in view the fact that the investigation is complete and the challan stands presented and the fact that the material witnesses have not supported the case of the prosecution, this Court deems it appropriate to grant regular bail to the petitioner.

The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
