The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner was issued passport on 07.02.2005 which expired on 06.02.2015. He worked as driver in Saudi Arabia and returned to India on a fake passport. An FIR No. 76 of 2009, under Sections 419, 420, 468, 471 of IPC and Section 12 of Passport Act was registered against the petitioner at Police Station IGI Airport, New Delhi. The petitioner, vide judgment dated 08.09.2012 passed by Addl. Chief Metropolitan Magistrate-1/Plea Bargaining Judge, Dwarka, New Delhi, was convicted and sentenced to imprisonment of period already undergone and fine of Rs. 10,000/- was also PARAMJIT KAUR SAINI 2024.02.07 04:59 I attest to the accuracy and integrity of this document

CWP No.2658 of 2024 -2- 2024:PHHC:016666 imposed. Fine stands paid. The petitioner applied for re-issuance of passport on 20.06.2023.

Notice of motion.

Ms. Sehej Sandhawalia, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. She submits that petitioner may be directed to appear before the passport authority alongwith requisite documents. Thereafter, the passport authority would pass an appropriate order within six weeks. 5.

Learned counsel for the petitioner agrees with the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 05.03.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 05.03.2024.
