(ORAL) A perusal of the petition reveals that the petitioner did not mention about the criminal antecedents.
Senior counsel appearing for the petitioner submits that it is a bonafide error and as per instructions given to him through his instructing counsel that the petitioner has no criminal antecedents apart from the cases meant with this transaction. Counsel for the petitioner submits that he be permitted to withdraw the present petition with liberty to file fresh petition and arrest of the petitioner may be stayed in the meantime.
Given above, the present petition stands disposed of having been withdrawn with liberty to the petitioner to file a fresh petition declaring all the criminal antecedents. However, in view of aforesaid statement of counsel for the petitioner, arrest of the petitioner shall remain stayed till 13.02.2023. All pending miscellaneous applications, if any, stand disposed of.
