Prayer made in the present petition is for directing the respondents to release the balance amount of Rs.1,00,150/- incurred by the petitioner for the treatment of his wife.

Learned State counsel, on instructions from Ms. Rajni, Assistant O/o Director Treasury & Account Department, Haryana, submits that out of the aforesaid amount, about Rs.38,000/- though was not payable, being on account of tests conducted outside PGI, however, considering the case of the petitioner sympathetically, his wife having unfortunately expired, the same has also been reimbursed by relaxing the condition of obtaining NAC from the said hospital. She also submits that the balance amount is not payable on account of the fact that it is an expense incurred for consumable items and not covered by any Instructions/Policy.

In view of the above, the present petition is disposed of, reserving the petitioner with a liberty to represent to the respondents regarding the aforesaid, in case there are instructions that entitle him for the same, which if submitted in 4 weeks be considered, in accordance with law, expeditiously.
