**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 261 dated 27.6.2019 under Sections 307, 34 IPC (Sections 120-B, 201 IPC and Section 25 of the Arms Act, 1959 added later on) registered at Police Station Chand Hut, District Palwal.

Learned counsel for the petitioner submits that petitioner has been in custody since 11.9.2019 and he has been involved in the present case on the basis of supplementary statement of complainant Indraj which was recorded on 1.9.2019 and the disclosure statement suffered by Mange Ram. Learned counsel further submits that co-accused Mange Ram has already been granted bail by this Court on 17.1.2020 and there is no case pending against the petitioner.

Learned State counsel, on instructions from ASI Munin Singh, submits that the petitioner was riding the motorcycle and co-accused GURPREET SINGH 2020.02.14 17:44 I attest to the accuracy and authenticity of this document chandigarh Mukesh, who has given a fire shot injury, was the pillion rider.

CRM-M No. 5700 of 2020 -2The petitioner has been in custody since 11.9.2019. The co-accused has already been granted regular bail by this Court. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
