IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-5500-2020 Decided on : 07.02.2020 Surjan Singh . . . Petitioner(s)

Versus

The State of Punjab . . . Respondent(s)

CORAM:

HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL PRESENT: Mr. Harsh Goyal, Advocate for the petitioner(s).

**** MANJARI NEHRU KAUL, J. (Oral) The instant petition has been filed under Sections 438 Cr.P.C., for grant of anticipatory bail, in case FIR No. 131, dated 22.12.2019, registered under Sections 341, 323, 354-D, 34 IPC (later on added Section 354-B & Sections 3 & 4 of the POCSO Act), at Police Station Sandaur, District Sangrur. Learned counsel for the petitioner inter alia contends that it is a case of false implication and the allegations, which have been levelled in the FIR in question do not attract the offence under Sections 354-B IPC and Sections 3 & 4 of the POCSO Act. However, on a perusal of the instant FIR, it is clearly evident that the petitioner has been involved in such like incidents in the past also and each time as per the allegations in the instant FIR, he had been tendering apology and getting away. Therefore, keeping in view the allegations levelled against the petitioner, no ground for grant of anticipatory bail is made out. Dismissed.
