The petitioner-Gurjant Singh has filed the present petition under Section 438 Cr.P.C. for grant of anticipatory bail in cross case bearing DDR No.21 dated 13.3.2018 for offences under Sections 307/452/148/149 IPC and under Sections 25/27 of Arms Act registered at Police Station Sadar Patti, District Tarn Taran in FIR No.46 dated 9.3.2018 under Sections 307, GAURAV SOROT 2021.09.28 16:02 I attest to the accuracy and integrity of this document

The State counsel on the instructions from ASI Charan Singh submits that the petitioner has joined the investigation and is not required by the police for any further investigation including custodial interrogation. The petitioner is arrayed as an accused in the cross-version, as per which, he was empty handed at the time of the alleged occurrence. Gurpreet Singh, main accused in the cross-version, who was allegedly armed with revolver, at the time of the occurrence and fired shots was granted anticipatory bail by this Court vide order dated 12.3.2020. Also, as per allegations appearing in the main FIR one Surinder Singh caused fire arm injury to the petitioner.

Admittedly, the petitioner has joined the investigation with the police on the basis of order of interim bail dated 7.2.2020 and is not required for any further investigation. So no purpose will be served even if the petitioner is sent police custody, at this stage. Consequently, the present petition is allowed and the order of interim bail dated 7.2.2020 is hereby confirmed subject to the conditions envisaged under Section 438(2) Cr.P.C.
