Petitioners - Harsh Bala, aged about 65 years and her husband Kul Bhushan Bajaj, aged about 67 years, both residents of B-06/194, Old Grain Market Batala, Police District Batala, District Gurdaspur, have brought the instant petition under Section 482 Cr.P.C., craving for issuance of a direction to the official respondents not to harass them at the instance of private respondents no. 5 to 8, contending that their son Sumit, residing in Singapore, had filed a police complaint against his wife Pallavi Marwaha, who left that country secretly. Pallavi Marwaha being wife of their son Sumit Bajaj, is their daughter-in-law and she alongwith her parents and brother, is threatening the petitioners and harassing them by lodging BANITA CHUGH 2021.02.19 14:17 I agree to specified portions of this document

CRM-M-7965 of 2021 -2complaints to the police. The petitioners had submitted a representation dated 16.1.2021, to the police authorities, but no action has been taken, as such, they have approached this Court. Notice of motion to the official respondents no. 1 to 4. At this state, Mr. J.S. Ghuman, DAG, Punjab, has accepted notice on behalf of State-respondents No. 1 to 4. Learned State counsel, on instructions from SI Harjit Singh, has stated that no FIR has been registered against the petitioners and though a complaint was received against petitioners, but that has since been filed and as such the petitioners are not required by the local police of Batala in connection with any FIR or enquiry. It being so, the part of petition with regard to harassment of petitioners at the hands of their daughter-in-law Pallavi Marwaha - respondent No.5, through the police authorities of Batala, has become infructuous.

As far as, their prayer with regard to safeguarding their lives and liberty, it is directed that SSP, Batala, shall look into their representation, copy Annexure P-6; assess the threat perception to the petitioners and if he finds that some action in the matter is required to be taken, then needful be done in accordance with law. The petition stands disposed of accordingly.
