This is an application for restoration of the contempt petition which was dismissed for non-prosecution by this Court vide order dated 23.09.2025.

Mr. Abhishek Goyal, Advocate appears and accepts notice on behalf of the respondent. He states that he has no objection if the present application is allowed.

In view thereof, the present application is allowed and the contempt petition is restored to its original number and status. With the consent of learned counsel for the parties, the contempt petition is taken on Board today itself.

Learned counsel for the respondent-mother, on instructions from the respondent-mother, states that the respondent-mother would have no objection if the petitioner-father meets the minor child on every first and third Sunday at City Mall, Kota, Rajasthan. It is further stated that the respondentmother would bring the minor child to the City Mall, Kota, Rajasthan at 11:00 am and the petitioner-father will be allowed to spend some quality time with the minor child i.e. from 11:00 am to 2:00 pm. The petitioner-father shall hand over the custody of the minor child back to the respondent-mother at 2:00 pm. 6.

Learned counsel for the petitioner-father, on instructions from the petitioner-father, states that the petitioner-father would be satisfied with this arrangement.

Both the counsel assure the Court that the parties would behave in a cordial manner and would not indulge in any unruly behavior. They further assure the Court of full cooperation, keeping in view the interest and the welfare of the minor child.

In view of the above, it is directed that the respondent-mother shall bring the minor child to the City Mall, Kota, Rajasthan at 11:00 am on every first and third Sunday of the month. The petitioner-father would have custody of the minor child from 11:00 am to 2:00 pm. The respondent-mother would stay away and let the petitioner-father and the minor child spend quality time with each other. The petitioner-father shall hand over the custody of the minor child back to the respondent-mother at 2:00 pm. Both the counsel have assured the Court that the parties would cooperate and behave in a cordial

-3manner, keeping in view the interest and welfare of the minor child. The petitioner-father would intimate the respondent-mother two days in advance regarding his program.
