By way of filing the present petition, the petitioners have alleged willful disobedience of the order dated 13.09.2018, passed by this Court in CWP-262-2018 (Annexure P-1), whereby, the respondents were directed to consider the case of the petitioners for promotion, as per the "Haryana Municipal Services (Integration, Recruitment and Conditions of Service) Rules, 1982".

I have heard learned counsel for the parties and perused the paper book.

As per the reply dated 11.07.2023, all the petitioners except petitioner No.2-Mohinder Singh, were promoted to the post of Sub-Fire Officer vide separate orders referred to in Para No.9 of the said reply. However, petitioner No.2-Mohinder Singh was not promoted to the said post

 due to non-availability of vacancy under the Old Service Rules namely "Haryana Municipal Service Rules, 1982" and "Haryana Municipal Corporation Employees Rules, 1998". It is further alleged that petitioner No.1-Mam Raj, petitioner No.7-Ramjan, petitioner No.8-Narender Kumar, petitioner No.9-Ramesh Kumar, petitioner No.10-Dinesh Kumar and petitioner No.12-Rajesh Kumar were wrongly promoted as there was no vacancy in the concerned Municipal Corporations/Municipalities under the Old Service Rules,.

Learned State counsel, on instructions from Mr. Amar Singh, Superintendent, Fire and Emergency Services, Haryana, Panchkula, who is present in the Court, has informed that the said promotion orders have been withdrawn subsequently. It is further informed that the aforesaid petitioners have already challenged the orders, whereby, the promotions were withdrawn, by way of filing separate writ petitions bearing Nos. CWP-24888-2023 and CWP-6829-2022.

Learned counsel for the petitioners has confirmed the filing of separate writ petitions on behalf of the petitioners. 6.

In view of the peculiar facts and circumstances, the case of the petitioners has been considered, in view of the directions passed by this Court vide order dated 13.09.2018 (Annexure P-1). However, there is subsequent development for recalling the promotion orders regarding which, the said petitioners have already availed remedy by way of filing separate writ petitions.

Consequently, without commenting upon the merits of the orders passed by the respondents, whereby, the promotions have been

 recalled, the present petition stands disposed of as having been rendered infructuous.

Pending miscellaneous applications, if any, shall stand disposed of.
