IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-6581-2020 (O&M) Date of order: 13.03.2023 Vikas Bansal

...Petitioner(s)

Versus

State of Punjab

...Respondent(s)

CORAM:

HON'BLE MR. JUSTICE ANOOP CHITKARA

Present:

Mr. Vivek Gupta, Advocate for the petitioner.

Mr. IPS Sabharwal, DAG, Punjab.

**** ANOOP CHITKARA, J. (Oral) Seeking quashing/setting aside of proclamation order dated 6.9.2017, the petitioner has approached this Court under Section 482 CrPC. On a query from this Court, petitioner's counsel submits that the petitioner has still not surrendered.

Faced with the question of maintainability of this petition for quashing of proclamation order, when the petitioner has still not surrendered to the Court of justice, petitioner's counsel submits that he would be contended and satisfied if a direction is issued to the effect that in case the petitioner surrenders and files an application for bail, the same will be decided expeditiously. Given the fact that majority of the accused have been acquitted in the case, prayer of the petitioner is prima facie bona fide. Given above, the present petition is disposed of, however, this Court requests the trial Court to decide the petitioner's bail application, if so filed, expeditiously. Liberty is also reserved to the petitioner to file fresh petition for quashing of the proclamation order after he surrenders to the majesty of Court.
