Prayer made in the present petition for quashing the order dated 30.07.2003, whereby the claim of the petitioner for promotion as Punjabi Lecturer was rejected, might not, due to efflux of time, even be surviving. 2.

Learned State counsel refers to preliminary submissions Nos.2 and 3 of the written statement dated 26.05.2005, wherein it has been stated that in Punjab Education Service Rules, 1978, there are two channels of promotions from master/mistress cadre, one is to the post of lecturer cadre and the other is to the post of Headmaster/Headmistress and on the basis of these rules options are invited. At the time of promotions all masters/mistresses are not postgraduate and promotions to lecturer cadre are not seniority based alone. The petitioner did not submit his option by way of affidavit that he will not claim promotion to the post of Headmaster if promoted to the post of lecturer, thus he was not promoted on 08.10.2001 along with proforma respondent No.3. To these facts there was no rebuttal by filing any replication. 3.

Disposed of, reserving the petitioner with a liberty to get it revived, in case lis still subsists.
